1. Introduction
Welcome to Venguild.com (“Venguild,” “we,” “our,” “us”). These Terms of Service (“Terms”) govern your access to and use of our website, applications, products, and services (collectively, the “Services”). By accessing or using Venguild, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
2. Eligibility
You must be at least thirteen (13) years of age to use the Services. If you are under eighteen (18) years old, you may only use the Services with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. By using the Services, you represent and warrant that you meet these requirements.
3. User Accounts
In order to access certain features, you may be required to create an account. You agree to provide accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. If you are under eighteen (18), your parent or legal guardian is responsible for the security and supervision of your account.
4. Acceptable Use
You agree not to use the Services for unlawful, harmful, or fraudulent purposes. You further agree not to upload, share, or distribute content that is abusive, infringing, or otherwise harmful. You must not interfere with or attempt to disrupt the security, integrity, or proper functioning of the Services.
5. Intellectual Property
All content, software, trademarks, and materials available on or through the Services are the property of Venguild or its licensors. We grant you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works without our prior written consent.
6. User Content
You retain ownership of any content you submit or upload to the Services (“User Content”). By submitting User Content, you grant Venguild a worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, host, display, and distribute such content in connection with the Services. If you are under eighteen (18), you confirm that your parent or legal guardian has reviewed and approved your submission of User Content.
7. Third-Party Services
The Services may contain links to third-party websites or resources. We do not control and are not responsible for the content, policies, or practices of any third party. Your use of third-party services is at your own risk.
8. Termination
We may suspend or terminate your access to the Services, with or without prior notice, if we believe you have violated these Terms. You may also stop using the Services at any time.
9. Disclaimer of Warranties
The Services are provided on an “as is” and “as available” basis. We disclaim all warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by law, Venguild shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or in connection with your use of the Services.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. You further acknowledge that our collection and processing of personal data shall be guided by Republic Act No. 10173, also known as The Data Privacy Act of 2012, and relevant issuances of the National Privacy Commission.
12. Changes to Terms
We may revise or update these Terms at any time. The updated version will be posted on the Services with a new “Last Updated” date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
